UPDATE: Russia/Ukraine Ubiquiti Statement

IMPORTANT: PLEASE READ THIS NOTICE CAREFULLY

Since our last announcement earlier this month, the U.S. has announced additional sanctions in response to Russia’s invasion of Ukraine.

    1. ADDITIONAL RESTRICTIONS ON CERTAIN DESTINATIONS

Ubiquiti products that are classified as “5A002-ENC Restricted” may only be sold, shipped or otherwise transferred to civil end-users in Russia or Belarus that are subsidiaries or joint ventures of U.S. companies or U.S. allies. Specifically, these products may only be sold to:

• wholly-owned U.S. subsidiaries;
• foreign subsidiaries of U.S. companies that are joint ventures with other U.S. companies;
• joint ventures of U.S. companies with companies headquartered in countries from Country Group A:5 and A:6 in Supplement No. 1 to Part 740 of the EAR countries (allied countries);
• wholly-owned subsidiaries of companies headquartered in allied countries; or
• joint ventures of companies headquartered in allied countries with other companies headquartered in allied countries.

This means that the sale, shipment or other transfer of any Ubiquiti product classified as "5A002" into Russia or Belarus is prohibited, subject only to the limited exceptions above. Ubiquiti products classified as “5A992” or “EAR99” may not be sold, shipped or otherwise transferred to government end-users in Russia or Belarus.     2. SCOPE OF RESTRICTIONS

Each of these prohibitions apply to the direct or indirect sale, shipment or other transfer of any Ubiquiti products (1) directly by Ubiquiti, (2) by us as a distributor, and (3) by you as a direct or indirect reseller of Ubiquiti. Failure to comply with U.S. export control and trade and economic sanctions laws and regulations can result in criminal sanctions, civil fines, debarment from government contracting, the loss of U.S. export privileges, and imprisonment. The reach of these laws and regulations covers U.S. persons as well as foreign persons, wherever located.

We as a distributor have a responsibility to make you aware of these sanctions and regulations and are expectant of your cooperation.

By directly or indirectly selling, shipping, using or otherwise transferring Ubiquiti’s products, you are agreeing to comply with all applicable export and reexport control laws and regulations, including each of those referenced herein.
